Ok I have researched this but cannot find an answer. It was a topic for heated debate in my local yesterday.

A learner driver gets stopped by the police and found to be sober. However, the police suspect that qualified driver in the passenger seat is intoxicated, but he refuses a breath test saying he is not in control of the vehicle.

What would happen to the learner and experienced driver from hereonin?

The so called "qualified driver" should have been dragged out of the car and given a good hiding by the cops.

The young female "learner" should get a ticking off about not getting into vehicules with drunken men:facepalm-hand-gesture-smiley-emoticon:

he/she is a learner & doesn't have a full licence so relies on the full licence holder....this is why a learner cannot go out on their own.

I get what you are saying but he wasn't driving.

Would he lose his licence?
